Your school and School Moments, Inc recognizes the need to provide additional privacy protections when children visit the SchoolMoments.com Website ("Website"). We explain those additional protections here in this Children's Privacy Policy. The Children's Privacy is part of our general Terms of Use and our general Privacy Policy, and for your convenience, this Children's Privacy Policy uses terms that are defined in those policies.

The Children’s Online Privacy Protection Act (“COPPA”) requires that the operator of a web site (in this case, your school) if it is not a non-profit organization, informs parents and legal guardians about information they collect, use and disclose personal information from children under 13 years of age, and that they obtain the consent of parents and guardians in order for children under 13 years of age to use certain features of the School Moments website. Below, is a general explanation of how this site may be used by an operator (your child’s school) however School Moments requires that if COPPA laws apply to your situation, that you gain specific knowledge of your school’s intended use of this web site, and that you give written consent for your child to participate. This general information provided is for information purposes and may or may not be applicable to every operator. When the term “parent” is used below, it includes legal guardians.

Information the School Collects About Children

In general, children can visit schoolmoments.com without any personal information being collected. However, the primary service offered by this Website for the creation of a publication that student's make for their personal subscribers, which requires the collection of certain information from children, their parents, their teachers and their schools.

Your child's school will only request this information of students, teachers, designated volunteers (aides, parent volunteers), parents, other authorized staff from whom the school administrator has specifically given a private password for access and (limited use) of the schoolmoments.com web site (hereinafter, "Permitted Users"). Personal Information that might be collected for publication production includes:

Each student and parent is assigned a unique access code to be shared by the student and parent to log onto the Website to enter information.

How We Use and Share Personal Information Collected From Children

Information submitted through the http://schoolmoments.com Web site by Permitted Users will be used to produce a student publication, which will be shared with subscribers in a restricted and selective manner as outlined above. A student's school will have access to this information. Parents can access their students writings and associated pictures that are pending publication. School Moments, Inc does not reveal information about students, parents, teachers or subscribers to any other third parties, except as provided in the next paragraph.

The School and/or School Moments, Inc will disclose personal information about students, without notice, if required to do so by law or in the good faith belief that such action is necessary to (a) conform to the edicts of the law or comply with legal process served on School Moments on the Website; (b) protect and defend the rights or property of the school or on School Moments, or (c) act in urgent circumstances to protect the personal safety of users of the school or on schoolmoments.com or the public.

As School Moments, Inc continues to develop its business, it might sell or buy stores or assets. In such transactions, customer information generally is one of the transferred business assets. Also, in the unlikely event that School Moments, Inc or substantially all of its assets are acquired, customer information will be one of the transferred assets.

Parental Access, Changes, Deletions

Parents can access information collected about their children by logging onto the Website. Parents share a user identification and password with their children. Parents should contact the school to modify information submitted by or about their children, and parents may request that all information about their children be deleted from School Moments' servers. In addition, parents may request that the School ceases from the collecting of further information about their children. All such requests can be made by sending a written request to the student's school.

Notification of Policy Changes

School Moments, Inc. may amend this Children's Privacy Policy at any time. We will provide all Operators of this Web site a notice by e-mail of any material changes in the way we intend to collect, use and/or share children's personal information. Please note that, at all times, parents should update their personal information to provide their child's school with current contact information. School Moments, Inc will apply material changes in our Children's Privacy Policy in conformance with applicable law, including any applicable provisions of COPPA that require parental consent.
